OVERVIEW

This website is operated by Mokoshi. Throughout the website, the terms “we”, “us” and “our” refer to Mokoshi.

These Terms of Service explain the conditions under which you may use our website and purchase products from us. By using this website or placing an order, you agree to these Terms of Service together with our Privacy Policy, Shipping Policy and Returns and Refunds Policy.

Nothing in these Terms affects your statutory rights under UK consumer law.

Mokoshi is an independent UK-based business offering handmade crochet flowers, floral arrangements, decorative artwork and seasonal decorations.

2. PRODUCTS

We make every reasonable effort to describe and photograph our products accurately.

Because our products are handmade, small variations in shape, size, colour, stitching and arrangement may occur. These natural variations are part of the handmade character of each item and are not considered faults.

Colours may also appear slightly different depending on your screen and device settings.

Product measurements are approximate. Please read the complete product description, care instructions and safety information before purchasing.

Many Mokoshi products are intended for decorative use only. They are not toys and may contain internal wire, small parts, plastic components, gypsum or other materials specified in the individual product description. Please keep decorative items away from young children, pets, open flames and sources of heat.

3. ORDERS

When you place an order, you are making an offer to purchase the selected products.

After placing your order, you will receive an order confirmation email. A contract between you and Mokoshi is formed when we accept your order.

We reserve the right to decline or cancel an order if:

  • The item is unavailable

  • There is an obvious error in the price or product description

  • Payment cannot be authorised

  • We are unable to deliver to the address provided

  • We reasonably suspect fraud or misuse of the website

If we cancel an order after payment has been taken, you will receive a full refund to the original payment method.

Please check your order details, email address and delivery address carefully before completing your purchase. Contact us as soon as possible if you discover an error.

4. PRICES AND PAYMENT

All prices are displayed in pounds sterling (GBP).

The product price shown at the time of purchase is the price you will pay. Any applicable taxes will be included as required by law. Delivery charges are shown separately before you complete checkout.

Payment must be received and authorised before an order can be processed.

We may change prices at any time, but price changes will not affect orders that have already been accepted.

5. SHIPPING AND DELIVERY

Available delivery options, charges and estimated delivery times are displayed during checkout and explained in our Shipping Policy.

Delivery dates are estimates and may be affected by postal delays, severe weather or other circumstances outside our reasonable control. We will contact you if we become aware of a significant delay.

Mokoshi remains responsible for the order until it is delivered to you or to a person identified by you to receive it.

You are responsible for providing a complete and accurate delivery address. If an order is returned because the address supplied was incorrect or incomplete, additional postage may be required before it can be sent again.

6. CANCELLATIONS, RETURNS AND REFUNDS

Your rights to cancel an order, return an item or request a refund are explained in our Returns and Refunds Policy.

Standard handmade products may be returned in accordance with that policy.

Products made to your individual specifications or personalised specifically for you cannot normally be returned because you have changed your mind. This does not affect your rights if an item is faulty, damaged, incorrectly described or not made according to the agreed specifications.

Nothing in these Terms limits your statutory rights.

7. INTELLECTUAL PROPERTY

All original photographs, product designs, written descriptions, graphics, branding and other content displayed on the Mokoshi website belong to Mokoshi or are used with permission.

You may view the website and share links to our products for personal, non-commercial purposes.

You must not copy, reproduce, sell, modify or use our photographs, descriptions, designs or other content for commercial purposes without prior written permission from Mokoshi.

8. WEBSITE USE

You must not use this website:

  • For any unlawful or fraudulent purpose

  • To introduce viruses, malicious code or other harmful material

  • To attempt to gain unauthorised access to the website or another customer’s information

  • To copy or collect website content or personal information without permission

  • To interfere with the security or operation of the website

We may restrict access to the website if we reasonably believe it is being misused.

9. THIRD-PARTY SERVICES AND SHOPIFY

Our shop is hosted by Shopify, which provides the ecommerce platform that allows us to sell our products.

Payments, delivery services and certain website functions may be provided by trusted third parties. Their own terms and privacy practices may also apply when you use their services.

Any purchase made from this store is a transaction directly between you and Mokoshi. Shopify is not the seller of Mokoshi products.

10. PRIVACY

We process personal information in accordance with our Privacy Policy and applicable UK data protection law.

Information may also be processed by Shopify and other service providers where necessary to operate the store, process payments and deliver orders.

11. LIABILITY

We do not exclude or limit liability where it would be unlawful to do so. This includes liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, and your statutory rights relating to goods that are faulty, not as described or not of satisfactory quality.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from a purchase made for personal use.

You are responsible for following the care and safety instructions supplied in the product description and with the item.

12. CHANGES TO THESE TERMS

We may update these Terms of Service when necessary to reflect changes to our business, website or legal obligations.

The version that applies to your purchase will be the version published on the website when your order was placed.

13. GOVERNING LAW

These Terms are governed by the laws of England and Wales.

If you live elsewhere in the United Kingdom, any mandatory consumer protections and rights to bring proceedings in your local courts remain unaffected.
